2. Description of Service

Saltwater Pros operates an online marketplace that connects anglers with independent charter fishing captains. We facilitate bookings, payments, and communications between users and captains. Saltwater Pros is not a charter fishing operator and does not own or operate any fishing vessels.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain the security and confidentiality of your account credentials
Be responsible for all activity that occurs under your account
Notify us immediately of any unauthorized use of your account

4. Bookings and Payments

When you book a charter through Saltwater Pros:

You agree to pay the total amount displayed at the time of booking, including any applicable fees
Payment is processed through our third-party payment processor (Stripe)
Cancellation and refund policies vary by captain and are displayed on the booking page
Saltwater Pros collects a service fee for facilitating the transaction

5. Charter Captain Obligations

Charter captains listed on Saltwater Pros agree to:

Maintain all required licenses, permits, and insurance
Provide accurate descriptions of their charters and services
Honor all confirmed bookings made through the platform
Operate their vessels in compliance with all applicable laws and safety regulations
Respond to inquiries and trip requests in a timely manner

6. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose
Circumvent the platform to avoid paying applicable fees
Post false, misleading, or fraudulent content
Harass, abuse, or harm other users or captains
Attempt to gain unauthorized access to any part of the Service
Scrape, data-mine, or use automated tools to extract data from the Service

7. Limitation of Liability

Saltwater Pros acts as a marketplace connecting anglers with charter captains. We are not responsible for:

The quality, safety, or legality of any charter trip
The accuracy of listings or captain profiles
Any injuries, damages, or losses incurred during a charter trip
Weather-related cancellations or fishing conditions

To the fullest extent permitted by law, Saltwater Pros shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

8. Intellectual Property

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, and software) are the exclusive property of Saltwater Pros and are protected by copyright, trademark, and other intellectual property laws.

9. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Florida. You agree to waive any right to a jury trial or to participate in a class action.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
